Overview

Probate is legal process that gives recognition to a will; it typically takes place in probate court, upon demise of a person and directs transfer or distribution of his/her estate to heirs or beneficiaries. The legal proceeding of probate includes: an executor of a will files formal petition with probate court and gives formal notice to heirs and beneficiaries; proving in court that a deceased person's will is valid; identifying and inventorying the deceased person's property; having the property appraised; liquidating debts and paying taxes; distributing the remaining property as will/bequest directs. With respect to legal implications of probate, at Murashkovskiy PLLC we assist and provide representation and uphold interests of heirs, beneficiaries, executors and other lawfully eligible parties. Among other aspects, we focus on two crucial areas of the process: Probate Administration and Probate and Trust Litigation. Probate Administration typically includes filing all necessary court and tax forms, transferring legal titles/deeds to intended recipients, settlement of all outstanding liabilities and final expenses of the deceased, and remote assistance to out-of-state beneficiaries. Probate and Trust Litigation is associated with disputes between interested parties that may arise during the process of estate and assets division or concerns regarding validity of will.
